Overview

A difficult birth or injury to the baby can arise because of the baby’s size or the location during labor and delivery. A birth injury is categorized as any kind of harm or injury afflicted to an infant's body before, during, or slightly after the child's birth. Complications through the course of pregnancy or labor can produce a wide variety of complications for a newborn baby. Birth injuries vary greatly - from very minor to being so serious as to cause the death of the infant. There are many conditions that are associated with strenuous births. A doctor should be conscious of these conditions. These conditions may call for specific procedures and should be identifiable to an obstetrician. If the obstetrician does not use reasonable attention and fails to detect such a condition, he or she may be responsible for damages if that failure leads to a birth injury.

Orlando Birth Injury AttorneysAccording to The March of Dimes, 60 percent of birth defects are due to unidentifiable causes. Many developmental defects and fetal deaths, however, are attributable to an expectant mother’s exposure to toxic substances. Studies suggest that women living within two miles of a landfill have an increased risk of giving birth to a baby with spina bifida, a hole in the heart, or other defects. Pregnant women exposed to strong levels of pollutants have almost three times the risk of delivering an infant with a cardiac condition. It is well known that Polychlorinated biphenyls (PCBs) pose a hazard to pregnant women and may inhibit a child’s intellectual ability, memory and attention span. Microcephaly (an unusually small head circumference) may be caused by harmful in utero factors such as pharmaceutical drugs, radiation, or a mother’s prenatal infection of rubella (German measles).

Pre-natal exposure to heavy metals (gold, lead, and mercury), cleaning solutions, paint, caffeine, radiation and drugs and alcohol may also cause birth defects. Manufacturers who fail to disclose (via labeling) the risks their products may pose to pregnant women can be held responsible for the birth defects caused.
